Terms of Service
Effective October 1, 2026
These Terms govern access to CloudKii websites, memberships, software, reseller tools, white-label capabilities, affiliate features, support services, and related services. By creating an account, purchasing a plan, or using CloudKii, you agree to these Terms and any order form or separate agreement that applies to your account.
1. Accounts and eligibility
You are responsible for accurate account information, safeguarding credentials, activity performed through your account, and maintaining lawful use of CloudKii. You may not share credentials in a way that bypasses plan limits or security controls.
2. Plans and subscriptions
CloudKii may offer recurring subscriptions, custom agreements, complimentary access, lifetime or legacy entitlements, trials, and one-time packages. The price and included rights shown at checkout or in a signed agreement control for that purchase. Unless otherwise stated, recurring plans continue until canceled.
3. Software access
Access to individual CloudKii apps is controlled by your current entitlements. Apps may be updated, replaced, renamed, retired, or moved between availability states. CloudKii may suspend access when required for security, abuse prevention, nonpayment, maintenance, or legal compliance.
4. Reseller and White Label use
Reseller and White Label rights are subject to the separate Reseller & White Label Terms. Pricing rules, platform fees, product branding permissions, customer ownership records, Stripe Connect requirements, and app-specific white-label capabilities are enforced by CloudKii.
5. Affiliate program
Affiliate participation is subject to the Affiliate Terms. Commissions may be pending until payments are settled and may be reversed for refunds, chargebacks, fraud, cancellations, duplicate attribution, or ineligible activity.
6. Payments
You authorize the payment processor to charge the payment method associated with your purchase. Applicable taxes may be added. Failed or overdue payments may result in a grace period, reduced access, suspension, or cancellation.
7. Acceptable use
You must comply with the Acceptable Use Policy and applicable law. You may not use CloudKii to facilitate fraud, unlawful messaging, unauthorized access, malware, abuse, harassment, infringement, or deceptive business practices.
8. Intellectual property
CloudKii and its software, designs, systems, code, trademarks, documentation, and platform materials remain the property of their respective owners except where a written custom-software agreement states otherwise. White Label rights change customer-facing presentation; they do not transfer ownership of the underlying CloudKii application or platform.
9. Availability and changes
CloudKii is provided on an evolving basis. We may modify features, interfaces, APIs, integrations, pricing for future purchases, and technical requirements. We aim to maintain reliable service but do not guarantee uninterrupted availability.
10. Disclaimers and limitation
To the maximum extent permitted by law, CloudKii is provided without warranties beyond those expressly stated in writing. CloudKii is not responsible for indirect, incidental, special, or consequential losses arising from use of the service. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.
11. Termination
You may stop using CloudKii and cancel recurring services according to the cancellation method provided in your account or purchase agreement. CloudKii may suspend or terminate access for material breach, abuse, fraud, security risk, or legal requirements.
